World Medical Association supports growing moves for plain tobacco packaging

The World Medical Association has supported the increasing number of countries planning to introduce plain packaging of tobacco products, including Australia and France. This week it joined the Norwegian Medical Association in supporting proposals to introduce plain packaging in Norway.

The WMA, in Oslo this week for its 200th Council meeting, was responding to a public consultation by the Norwegian Ministry of Health and Care Services suggesting that all tobacco products sold in Norway should have standardized packaging. The goal is to prevent tobacco use among children and young people. The consultation also discusses the possibility of stopping the influence of the tobacco industry on tobacco policy.

Dr. Xavier Deau, President of the WMA, said: ‘The WMA strongly supports this proposal for plain packaging. Four years ago we called on all national governments to follow the example of the Australian Government in introducing plain packaging to break the brand recognition and smoking cycle. We also deplored the legal moves being taken by the tobacco industry to oppose this.

Now we have evidence from Australia that plain packaging does lead to a reduction in the take up of cigarettes and tobacco.’

WMA policy declares that cigarettes are a serious threat to the life and health of individuals who use them and a considerable cost to the health care services of every country. It says that those who smoke predominantly start to do so while adolescents and that there is a proven link between brand recognition and likelihood of starting to smoke. And it adds that brand recognition is strongly linked to cigarette packaging and that plain packaging reduces the impact of branding, promotion and marketing of cigarettes.

Dr. Hege Gjessing, President of the Norwegian Medical association, said: ‘I welcome the WMA’s support. Tobacco is a serious threat to people’s health. The Norwegian Medical Association has a long history of supporting restrictions on tobacco. We supported the ban on tobacco advertising in 1973, and then we supported the ban on smoking in aeroplanes and the ban on smoking in restaurants.’

Tobacco Use Among Middle and High School Students — United States, 2011–2014

Tobacco use and addiction most often begin during youth and young adulthood (1,2). Youth use of tobacco in any form is unsafe (1). To determine the prevalence and trends of current (past 30-day) use of nine tobacco products (cigarettes, cigars, smokeless tobacco, e-cigarettes, hookahs, tobacco pipes, snus, dissolvable tobacco, and bidis) among U.S. middle (grades 6–8) and high school (grades 9–12) students, CDC and the Food and Drug Administration (FDA) analyzed data from the 2011–2014 National Youth Tobacco Surveys (NYTS). In 2014, e-cigarettes were the most commonly used tobacco product among middle (3.9%) and high (13.4%) school students. Between 2011 and 2014, statistically significant increases were observed among these students for current use of both e-cigarettes and hookahs (p<0.05), while decreases were observed for current use of more traditional products, such as cigarettes and cigars, resulting in no change in overall tobacco use. Consequently, 4.6 million middle and high school students continue to be exposed to harmful tobacco product constituents, including nicotine. Nicotine exposure during adolescence, a critical window for brain development, might have lasting adverse consequences for brain development (1), causes addiction (3), and might lead to sustained tobacco use. For this reason, comprehensive and sustained strategies are needed to prevent and reduce the use of all tobacco products among youths in the United States.

NYTS is a cross-sectional, school-based, self-administered, pencil-and-paper questionnaire administered to U.S. middle and high school students. Information is collected on tobacco control outcome indicators to monitor the impact of comprehensive tobacco control policies and strategies (4) and inform FDA’s regulatory actions (5). A three-stage cluster sampling procedure was used to generate a nationally representative sample of U.S. students who attend public and private schools in grades 6–12. This report includes data from 4 years of NYTS (2011–2014), using an updated definition of current tobacco use that excludes kreteks (sometimes referred to as clove cigarettes).* Of 258 schools selected for the 2014 NYTS, 207 (80.2%) participated, with a sample of 22,007 (91.4%) among 24,084 eligible students; the overall response rate was 73.3%. Sample sizes and overall response rates for 2011, 2012, and 2013 were 18,866 (72.7%), 24,658 (73.6%), and 18,406 (67.8%), respectively. Participants were asked about current (past 30-day) use of cigarettes, cigars (defined as cigars, cigarillos, or little cigars), smokeless tobacco (defined as chewing tobacco, snuff, or dip), e-cigarettes,† hookahs,§ tobacco pipes (pipes),¶ snus, dissolvable tobacco (dissolvables), and bidis. Current use for each product was defined as using a product on ≥1 day during the past 30 days. Tobacco use was categorized as “any tobacco product use,” defined as use of one or more tobacco products and “≥2 tobacco product use,” defined as use of two or more tobacco products. Data were weighted to account for the complex survey design and adjusted for nonresponse; national prevalence estimates with 95% confidence intervals and population estimates rounded down to the nearest 10,000 were computed. Estimates for current use in 2014 are presented for any tobacco use, use of ≥2 tobacco products, and use of each tobacco product, by selected demographics for each school level (high and middle). Orthogonal polynomials were used with logistic regression analysis to examine trends from 2011 to 2014 in any tobacco use, use of ≥2 tobacco products, and use of each tobacco product by school level, controlling for grade, race/ethnicity, and sex and simultaneously assessing for linear and nonlinear trends.** A p-value <0.05 was considered statistically significant. SAS-Callable SUDAAN was used for analysis.

In 2014, a total of 24.6% of high school students reported current use of a tobacco product, including 12.7% who reported current use of ≥2 tobacco products. Among all high school students, e-cigarettes (13.4%) were the most common tobacco products used, followed by hookahs (9.4%), cigarettes (9.2%), cigars (8.2%), smokeless tobacco (5.5%), snus (1.9%), pipes (1.5%), bidis (0.9%), and dissolvables (0.6%) (Table). Among high school non-Hispanic whites, Hispanics,†† and persons of non-Hispanic other races, e-cigarettes were the most used product, whereas among non-Hispanic blacks, cigars were used most commonly. Current use of any tobacco and ≥2 tobacco products among middle school students was 7.7% and 3.1%, respectively. E-cigarettes (3.9%) were the tobacco product used most commonly by middle school students, followed by hookahs (2.5%), cigarettes (2.5%), cigars (1.9%), smokeless tobacco (1.6%), pipes (0.6%), bidis (0.5%), snus (0.5%), and dissolvables (0.3%).

From 2011 to 2014, statistically significant nonlinear increases were observed among high school students for current e-cigarette (1.5% to 13.4%) and hookah (4.1% to 9.4%) use (Figure 1). Statistically significant linear decreases were observed for current cigarette (15.8% to 9.2%) and snus (2.9% to 1.9%) use. Statistically significant nonlinear decreases were observed for current cigar (11.6% to 8.2%), pipe (4.0% to 1.5%), and bidi (2.0% to 0.9%) use. Current use of any tobacco product (24.2% to 24.6%) and use of ≥2 tobacco products (12.5% to 12.7%) did not change significantly from 2011 to 2014. Among middle school students, similar trends were observed during 2011–2014 (Figure 2). A statistically significant linear decrease was observed only in middle school students currently using ≥2 tobacco products (3.8% to 3.1%).

In 2014, an estimated 4.6 million middle and high school students currently used any tobacco product, of which an estimated 2.2 million students currently used ≥2 tobacco products. Of current tobacco users, 2.4 million used e-cigarettes and 1.6 million used hookahs. The largest increase in current e-cigarette use occurred from 2013 to 2014. Current e-cigarette use tripled from 2013 (660,000 [4.5%]) to 2014 (2 million [13.4%]) among high school students (Figure 1); and among middle school students, prevalence increased by a similar magnitude, from 1.1% (120,000) to 3.9% (450,000) (Figure 2). From 2013 to 2014, substantial increases also were observed for current hookah use, with prevalence almost doubling for high school students from 5.2% (770,000) to 9.4% (1.3 million) and for middle school students from 1.1% (120,000) to 2.5% (280,000) over this period.

Discussion

From 2011 to 2014, substantial increases were observed in current e-cigarette and hookah use among middle and high school students, resulting in an overall estimated total of 2.4 million e-cigarette youth users and an estimated 1.6 million hookah youth users in 2014. Statistically significant decreases occurred in the use of cigarettes, cigars, tobacco pipes, bidis, and snus. The increases in current use of e-cigarettes and hookahs offset the decreases in current use of other tobacco products, resulting in no change in overall current tobacco use among middle and high school students. In 2014, one in four high school students and one in 13 middle school students used one or more tobacco products in the last 30 days. In 2014, for the first time in NYTS, current e-cigarette use surpassed current use of every other tobacco product, including cigarettes.

These findings are subject to at least three limitations. First, data were collected only from youths who attended either public or private schools and might not be generalizable to all middle and high school-aged youth. Second, current tobacco use was estimated by including students who reported using at least one of the nine tobacco products asked in the survey but might have had missing responses to any of the other eight tobacco products; missing responses were considered as nonuse, which might have resulted in underestimated results. Finally, changes between 2013 and 2014 in the wording and placement of questions about the use of e-cigarettes, hookahs, and tobacco pipes might have had an impact on reported use of these products. Despite these limitations, overall prevalence estimates are similar to the findings of other nationally representative youth surveys (6,7).

Tobacco prevention and control strategies, including increasing tobacco product prices, adopting comprehensive smoke-free laws, and implementation of national public education media campaigns, might have influenced the reduction of cigarette smoking in youths (2). However, the lack of decline in overall tobacco use from 2011 to 2014 is concerning and indicates that an estimated 4.6 million youths continue to be exposed to harmful constituents, including nicotine, present in tobacco products (Table). Youth use of tobacco in any form, whether it be combustible, noncombustible, or electronic, is unsafe (1); regardless of mode of delivery, nicotine exposure during adolescence, a critical time for brain development, might have lasting adverse consequences for brain development (1), causes addiction (3), and might lead to sustained use of tobacco products. Rapid changes in use of traditional and emerging tobacco products among youths underscore the importance of enhanced surveillance of all tobacco use.

Sustained efforts to implement proven tobacco control policies and strategies are necessary to prevent youth use of all tobacco products. In April 2014, FDA issued a proposed rule to deem all products made or derived from tobacco subject to FDA jurisdiction, and the agency is reviewing public comments on the proposed rule (8). Regulation of the manufacturing, distribution, and marketing of tobacco products coupled with full implementation of comprehensive tobacco control and prevention strategies at CDC-recommended funding levels could reduce youth tobacco use and initiation (1,2,9). Because use of emerging tobacco products (e-cigarettes and hookahs) is increasing among middle and high school students, it is critical that comprehensive tobacco control and prevention strategies for youths should address all tobacco products and not just cigarettes.

Hong Kong Customs to work with Guangdong counterparts to crack down on cigarette smuggling

Hong Kong Customs will seek help from their mainland counterparts to investigate a cross-border syndicate after making their biggest seizure of smuggled cigarettes this year.

The HK$4.9 million haul of untaxed cigarettes was discovered hidden in two shipping containers which arrived from Guangdong by sea on Thursday.

“The containers were declared to have carried electronic parts and LED lights but its shipper is not involved in such business. This aroused our officers’ suspicions,” Superintendent Cecilia Yeung Kai-fei, deputy head of the Customs’ revenue and general investigation bureau, said.

The two containers were taken to a Customs cargo examination plant in Tuen Mun for inspection.

Under an X-ray examination, suspicious images were found at the back of the containers. A total 122 boxes of illicit cigarettes were uncovered after the two containers were opened for inspection. No one was arrested.

“Our investigation indicates that consignment was for local consumption,” Yeung said.

She said it was the fourth major seizure of contraband cigarettes this year but “this is the biggest”.

“We believe there is a cross-border syndicate behind the shipment because it involved such large quantity of illicit cigarettes,” she said.

“We will ask our Guangdong counterparts for help in our follow-up investigation.”

In the previous three cases detected in the first quarter of this year, in total 2.4 million cigarettes, worth about HK$6.3 million, were smuggled into Hong Kong from the mainland by land or by sea.

“Syndicates use different methods of smuggling in an attempt to evade our detection,” Yeung said, adding that the latest seizure showed the effectiveness of enforcement strategy.

She said Hong Kong Customs would continue to carry out stringent enforcement actions against such illegal activities.

Last year, customs officers confiscated 14 millions of illicit cigarettes worth HK$37.8 million in seven major seizures.

Under the import and export ordinance, smuggling is a serious offence that carries a maximum penalty of a HK$2 million fine and seven years of imprisonment.

THE DANGERS OF ELECTRONIC CIGARETTES – NEW RESEARCH

Over the past few years, electronic cigarettes (often called a personal vaporizer, e-cigarette, or many other trendy descriptions–I’ll abbreviate them as EC, just to save space) have become a popular alternative to tobacco cigarettes. They originally were developed as a tool to quit cigarette smoking, which is factually linked to lung cancer and other respiratory diseases.

However, ECs have become much more than a tool to end smoking, but they have evolved into popular subculture phenomenon known as the “vaping community” that, in many respects, seem to mimic the marijuana advocates. The vaping community continues to push a belief that ECs are safer than traditional cigarettes, have little health risk to the vaper (electronic cigarette smoker), and is much more socially acceptable than smoking cigarettes or cigars.

One of the most ironic and amusing stories about ECs is that Jenny McCarthy, the antivaccination expert who thinks that all ingredients in vaccines are dangerous, has become an advocate for vaping. I bought a brand new, upgraded version 4.7, nuclear powered irony meter, and it just broke. It’s possible Jenny caused a nuclear accident in my house.

What are the dangers of electronic cigarettes? Are there any at all?

What is an electronic cigarette?

Typically, electronic cigarettes use a battery powered vaporizer to aerosolize a liquid that are generally solutions of propylene glycol (a relatively safe diol), glycerol (a commonly used and very safe food and pharmaceutical additive), or both, plus nicotine and flavorant chemicals. The nicotine is usually considered the addictive compound in cigarettes, and the nicotine in the EC is isolated and purified from tobacco plants, so it’s the same one as in any tobacco based smoking product.

The aerosol is inhaled, like a typical cigarette, so the original hypothesis is that it would help wean a smoker from cigarettes by giving them the flavor, nicotine, and inhaling action of a real cigarette, but in a form that many believe is safer than a cigarette. So even if the smoker became addicted to the EC, it was assumed that it was a lot less dangerous than smoking a cigarette. From a financial standpoint, the electronic smoking manufacturers probably would love to get cigarette smokers to become addicted to their device, moving the profits from Big Tobacco to Big Vaper.

Safety of electronic cigarettes?

Ironically (and now my irony meter is broken, so I can’t tell you how ironic this is), the “wars” over the dangers of electronic cigarettes kind of reminds me of the original wars over the safety of tobacco cigarettes. Everyone has an “opinion,” while real scientific research is completely ignored by the side pushing the item. And meanwhile, many communities have not banned public use of ECs, so you might be in a restaurant somewhere, and a guest in the next table will fire up their EC, and you get to inhale the aerosol concoction.

The respiratory tract, including the mouth, throat, trachea and lungs, are extraordinarily sensitive to compounds in aerosol form that can get deep into the lungs, mostly because the cellular linings of these organs are made up of cells that divide frequently and are exposed directly to airborne contaminants. Cigarette smoke, industrial pollutants, asbestos particles, and many other things can be easily inhaled, then cause damage to the lung, many times in the form of cancer.

Even though the lung is sensitive to pollutants, most aerosol liquids aren’t going to do much harm. You can stand in a pine forest, inhale deeply, and there’s probably not much damage going to happen. You can smell a rose, or a freshly baked cake, and you’re going to be fine.

Even oncologists have published articles that seem to indicate there are a lot of unknowns about ECs, and concluded that:

In the absence of further data or regulation, oncologists are advised to discuss the known and unknown safety and efficacy information on e-cigarettes with interested patients and to encourage patients to first try FDA-approved pharmacotherapies for smoking cessation.

These expert oncologists, who specialize in treating mouth and throat cancers, know that the evidence one way or another aren’t in, but in a form of a precautionary principle, suggest that ECs should be avoided. But otherwise, the data seems weak. Orac editorialized about the quality of science behind the safety or dangers of EC’s

I perused PubMed for data on e-cigarette safety, and I was appalled at the crappy quality of the studies out there. For instance, here are two more recent surveys compared to the review article I cited above. They tell us little or nothing more. Even surveys reporting adverse events are not particularly helpful.

This Internet forum survey, for instance, has a built-in selection bias. Even though it tells us that there are a wide variety of reported effects from e-cigarettes, including cough, headache, panic, nausea, tremor, fatigue, reflux, throat and mouth irritation, burning, dermatitis, and elevated blood pressure, it’s hard to tell what the true prevalence of such reported symptoms are.

Not surprisingly, given the uncontrolled nature of these studies, they showed that smokers generally liked e-cigarettes, think they help them decrease or quit smoking, and don’t cause any significant problems. It’s simply amazing how little hard data there are published.

Even more annoying is that the FDA regulates nicotine patches (and other forms of nicotine drug delivery), some of which require prescriptions from MD’s. Oddly, electronic cigarettes, which are, in fact, drug delivery systems, delivering a regulated drug, nicotine, are not subject to FDA control, at least as of today. As long as the electronic cigarette is not marketed with a therapeutic purpose, it is unregulated. That is a loophole 100 km wide, which has inspired a cottage industry in vaping.

Using Wikipedia as a cultural indicator of disputes between real science and those pushing their beliefs, the Electronic Cigarette article has been frozen to end content disputes. Since I’ve been involved with these types of articles in the past, it’s frustrating but humorous. And I don’t doubt that a few of the editors are employees of Big Vaper, trying to push their agenda. Of course, this is why Wikipedia remains a terrible source for anything important.

So is there any research at all about the safety?

Well, an article just published in the New England Journal of Medicine should move the discussion from a fallacious precautionary principle to a serious concern about the the safety of ECs. Using nuclear magnetic resonance (NMR) spectroscopy, a powerful tool used by biochemists to identify small concentrations of organic molecules, the researchers looked not at the pre-aerosolized liquid, which seems to contain safe compounds, but at the aerosol itself after vaping.

What they found may substantially increase concerns about the safety of vaping. The propylene glycol, which is in the pre-vaping liquid, breaks down, over time, into formaldehyde. The reaction between the electronic aerosolizer, propylene glycol, glycerol and formaldehyde creates a “formaldehyde releasing agent,” called formaldehyde hemiacetals, which are known as industrial biocides. Not good, even at the small levels within an EC aerosol.

Formaldehyde itself, in small amounts, is not dangerous. One’s own body creates formaldehyde as a byproduct of numerous biochemical reactions. Many foods contain lots of formaldehyde. But at those levels, it’s far below the dose implicated in any health risk.

But at higher levels, formaldehyde is strongly associated with certain cancers. It is considered a Group 1 compound, carcinogenic to humans, by the International Agency for Research on Cancer (pdf), making it one of the 114 compounds that are known carcinogens. And remember, this formaldehyde is heading to one of the most environmentally sensitive organs in the body, the lungs, mouth, throat, etc.

The researchers found that an e-cigarette user vaping at a rate of 3 ml per day (an average) would inhale 14.4±3.3 mg of formaldehyde per day in formaldehyde-releasing agents. In toxicology, it’s not the presence of something like formaldehyde that matters, it’s the actual dose. And this is where it gets interesting.

So, what does 14.4 mg mean to one’s health. Well, an average pack of tobacco cigarettes (20 of them) would deliver 3 mg of formaldehyde to the smoker. In effect, the EC smoker is inhaling nearly 5 packs of cigarettes worth of formaldehyde.

Now to be fair, tobacco based cigarettes have more than just formaldehyde as carcinogens. But how dangerous is 14.4 mg of formaldehyde?

The researchers calculated the increased lifetime risk of cancer for a tobacco cigarette who smoked one pack per day to be about 900 out of a million, meaning if you took a population of 1 million people, smoking cigarettes would mean 900 more people would contract cancer than the same population with no smokers.

Based on the level of 14.4 mg of formaldehyde, a known carcinogen, it would be estimated that inhaling 3 ml of electronic cigarette liquid in aerosol form would lead to a lifetime risk of cancer 4200 out of a million, nearly 5X larger risk than smoking cigarettes. The cancer risk might be substantially higher because of the type and nature of the form of formaldehyde created by the vaping process.

This moves the conversation from “we don’t know, but it’s probably safe” to “you’re inhaling some carcinogenic compounds that significantly increase your risk of cancer.” The burden of proof should begin shifting to the pushers of these things to show it’s safe over a long period of time. Moreover, it’s clear that the FDA needs to step in and regulate these products like cigarettes, meaning broad warnings of potential risks.

Caveats

This is one study by one group that have uncovered the level of formaldehyde and formaldehyde hemiacetals in the aerosols of electronic cigarettes. Before there is a consensus of medical science about these products, we’ll need a lot more data from a lot of different sources.

One criticism that the pro-vaping crowd will make is that this isn’t an actual clinical trial showing this dose of electronic cigarettes actually case X number of cancer cases. Unfortunately that takes time, because the cancer causing event may not cause a cancer until decades down the road. It took a lot of time for scientists to identify that cigarette smoking caused cancer, but after years of smokers and better diagnostic tools, by the late 1940’s, researchers could clearly identify the causal link between cigarettes and lung cancer.

Now, a lot of people are doing the typical thing when an article comes out. Pick on this. Pick on that. But like I said recently, only 1 in 100 published articles actually lead clinical importance in health. That’s 1%. Maybe this article contains the initial observations that show us that vaping is dangerous. Or not (and just because 1 in 100 studies are useful, that’s not a predictor, unless you like misusing statistics).

It indicates a potential concern. There should be more and better research, unless you’re in complete denial. And I’m not.

Children, teens and vaping

If there actually was evidence that vaping is a great way to stop real tobacco smoking, that would be a very convincing argument that vaping has some value to the world, far beyond its risks. It’s interesting that Big Tobacco (a group that really tries to harm people) is fighting electronic cigarettes with all the passion that they fight the CDC and FDA.

But like Big Tobacco, Big Vaping (it’s starting to be a thing) is trying, either passively or actively, to create a whole new market with children and teens. According to the New York Times,

…use of the devices among middle- and high school students tripled from 2013 to 2014, according to federal data released on Thursday, bringing the share of high school students who use them to 13 percent — more than smoke traditional cigarettes. The sharp rise, together with a substantial increase in the use of hookah pipes, led to 400,000 additional young people using a tobacco product in 2014, the first increase in years, though researchers pointed out it fell within the margin of error. About a quarter of all high school students and 8 percent of middle school students — 4.6 million young people altogether — used tobacco in some form last year.
Now, I’m not going to moralize what is good or bad about vaping. Cigarette smoking may be a moral issue for some, but for me it’s a health care issue. The same with vaping, and there are some serious health care problems with children and teens’ using electronic cigarettes.

According to Dr. Thomas R Frieden of the CDC,

We want parents to know that nicotine is dangerous for kids at any age, whether it’s an e-cigarette, hookah, cigarette or cigar. Adolescence is a critical time for brain development. Nicotine exposure at a young age may cause lasting harm to brain development, promote addiction, and lead to sustained tobacco use.
The CDC and other anti-tobacco advocates are extremely troubled by the CDC report. They warned that e-cigarettes were undoing years of progress among the country’s most vulnerable citizens by making the act of puffing on a tobacco product normal again, and by introducing nicotine, an addictive substance, to a broad population of teenagers.

Dr. Frieden continued,

…this is a really bad thing. This is another generation being hooked by the tobacco industry. It makes me angry.
I don’t really care if adults risk their lives with vaping (other than trying to quit cigarettes). That’s on them. But getting a child or teen addicted to nicotine and the act of smoking? That’s on the industry. We need to regulating vaping in the same way as smoking–no advertising, strong warnings, strict age laws for purchase, no vaping in any public areas. In essence, restricting vaping as harshly as we do cigarettes.

Here’s what we know now. Electronic cigarettes create a very carcinogenic compound, formaldehyde, which is causally related to increased risks of cancer. Furthermore, we know that the amount of formaldehyde and formaldehyde compounds that are in ECs possibly can be related to a potential 500% increase in cancer than may be caused by formaldehyde in cigarettes, which could be data that supports the dangers of electronic cigarettes.

If this risk is borne out by further chemical and biological research over the next months or years, then if you need your nicotine, either go with a real pharmaceutical like patches or gum, or back to cigarettes. They may be safer (and another irony meter is busted).

With this data, we need to move away from the precautionary principle, that is, we’re not sure it’s safe or unsafe, but until they prove it safe, don’t use it. I hate the precautionary principle, because it is a form of the Nirvana Fallacy, that is if you can’t prove something is perfect, then it’s bad, a fallacy loved by the anti-GMO crowd. But with this data, we move from a fallacy, to data about an inhaled carcinogen produced in rather alarming quantities by these electronic cigarettes. And don’t trust data from Big Vaper–they’re reading from the Big Tobacco playbook.

And let’s regulate this addictive method out of reach or use of children. Period.

One last thing. Those of us who don’t smoke nor think that vaping is wise may find this data troubling with respect to second-hand smoke or vapor. I rarely encounter cigarette smoke any more–it’s generally banned anywhere except maybe in your car.

But I’ve been noticing people vaping publicly. I used to throw water on cigarettes of chain smoking idiots at the next table in a restaurant (way before laws caught up with the science on second hand smoke). I suspect water will have the same effect on the electronics of these things. Oh wait, my city banned it everywhere cigarettes are banned. Yes!!!

The leaked text is full of dense legal jargon. But a close reading makes its corporate agenda crystal clear.

Secret negotiations on the Trans-Pacific Partnership (TPP), a trade and investment agreement involving 12 nations of the Pacific Rim, are coming to a close, and President Barack Obama will soon submit the final agreement to the U.S. Congress for approval.

Here are the Cliffs Notes in simple English.

Presumably, he will urge the deal’s passage with the same unsubstantiated and misleading claims his administration has offered all along: that the TPP will support Made-in-America exports, enforce fundamental labor rights, promote strong environmental protection, and help small business.

But a newly leaked document belies those claims. The Trans-Pacific Partnership’s text consists of a number of chapters, among the most important of which is the one on investments. On March 25, WikiLeaks released a confidential draft of that chapter dated January 20. The draft contains instructions indicating that it will be declassified only “Four years from entry into force … or, if no agreement enters into force, four years from the close of the negotiations.”

A quick reading of the leaked chapter makes it clear why TPP sponsors have gone to great lengths to keep their negotiations secret. The document substantiates claims by opponents that the TPP is a corporate-rights agreement designed to facilitate the export of U.S. jobs, allow corporations to sue governments for enacting labor and environmental protections, make it illegal for governments to favor local businesses, and advance the colonization of national economies by global corporations and financiers.

As problematic as this chapter is, we can be thankful that it is out in the open. Now the need is to understand what all the legalese means.

The leaked document includes many technical details decipherable only by trade lawyers. Here are the Cliffs Notes in simple English.

1. Favoring local ownership is prohibited

Let’s start with the Investment Chapter’s section on how the TPP’s member countries should treat foreign investors:

Each Party [country] shall accord to investors of another Party treatment no less favorable than that it accords, in like circumstances, to its own investors with respect to the establishment, acquisition, expansion, management, conduct, operation, and sale or other disposition of investments in its territory.

Put in plain English, the above paragraph means that signatory countries renounce their right to favor the domestic ownership and control of the lands, waters, and other productive assets and services essential to the lives and well-being of their people.

The 12 countries further renounce their right to favor locally owned businesses, corporations, cooperatives, or public enterprises devoted to serving their people with good local jobs, products, and services. They must instead give equal or better treatment to global corporations that come only to extract profits.

2. Corporations must be paid to stop polluting

Another provision limits what member countries can do in regard to corporate investments:

No Party may expropriate or nationalize a covered investment either directly or indirectly through measures equivalent to expropriation or nationalization (“expropriation”), except: (a) for a public purpose; (b) in a nondiscriminatory manner; (c) on payment of prompt, adequate, and effective compensation [emphasis added] … ; and (d) in accordance with due process of law.

This provision may sound reasonable, until you look at the chapter’s definition of “investment,” which includes “the expectation of gain or profit.” This odd definition means that a corporation can sue a signatory nation if the country deprives the corporation of expected profits by enacting laws that prohibit the company from selling harmful products, damaging the environment, or exploiting workers. Other language in the chapter makes it clear that this applies to actions at all levels of government.

In other words, a country in the TPP has every right to stop a foreign corporation from harming its people and the environment—but only if the country compensates the corporation for the expense of not harming them.

Similar provisions are already on the books in the North American Free Trade Agreement (NAFTA). According to Public Citizen’s Trade Watch,

Foreign firms have won more than $360 million in taxpayer dollars thus far in investor-state cases brought under NAFTA. Of the 11 claims currently pending under NAFTA, demanding a total of more than $12.4 billion, all relate to environmental, energy, land use, financial, public health and transportation policies—not traditional trade issues.

3. Three lawyers will decide who’s right in secret tribunals

The leaked chapter also describes how disagreements will be settled:

Unless the disputing parties otherwise agree, the tribunal shall comprise three arbitrators, one arbitrator appointed by each of the disputing parties and the third, who shall be the presiding arbitrator, appointed by agreement of the disputing parties.

The arbitrators are private lawyers who are not accountable to any electorate. They are empowered by the TPP to order unlimited public compensation to aggrieved investors. The proceedings and the identities of the tribunal members are secret, and the resulting decisions are not subject to review by any national judicial system.

According to The New York Times, NAFTA tribunals, on which the ones in the TPP are modeled, even have the power to overturn judgments of national courts—including the U.S. Supreme Court. John D. Echeverria, a law professor at Georgetown University, has called this method of dispute settlement “the biggest threat to United States judicial independence that no one has heard of and even fewer people understand.”

4. Speculative money must remain free

Yet another provision prohibits restrictions on movement of money from one country to another:

Each Party shall permit all transfers relating to a covered investment to be made freely and without delay into and out of its territory. …

Forms an investment may take include: (a) an enterprise; (b) shares, stock, and other forms of equity participation in an enterprise; (c) bonds, debentures, other debt instruments, and loans; (d) futures, options, and other derivatives.

Thus, the TPP guarantees the right of speculators to destabilize national economies through the manipulation of exchange rates and financial markets, without interference from national governments.

In so doing, the TPP strips national governments of the right to limit speculation in favor of investment in strong, stable, and productive national economies.

5. Corporate interests come before national ones

Another passage assures that corporations need bear no obligation to serve the interest of the people who live in the countries where they do business:

No Party may … impose or enforce any requirement or enforce any commitment or undertaking: (a) to export a given level or percentage of goods or services; (b) to achieve a given level or percentage of domestic content; (c) to purchase, use or accord a preference to goods produced in its territory, or to purchase goods from persons in its territory.

The article continues on with six additional provisions, which together prohibit governments from requiring that a foreign investor be under any obligation to serve the host country’s people or national interest.

Obama administration officials say these provisions are needed to level the playing field for American companies doing business abroad. This raises an important question: What is an American company?

The Institute for Policy Studies reports that U.S. corporations and their subsidiaries currently hold $2.1 trillion in profits offshore to avoid paying taxes to the government of the United States. These include highly profitable companies like Microsoft, Google, Apple, General Electric, Exxon Mobil, and Chevron. One wonders on what basis we should consider these globe-spanning, tax-dodging, job-exporting corporations to be American.

Approval of the TPP means sacrificing our democracy and our right to manage our markets and resources for the public good. And for what gain? To secure rights for corporations—which claim an American identity only when convenient—to exploit the peoples and resources of other countries that have signed the same nefarious agreement.

Abstract

Background

Most e-cigarette liquids contain flavour chemicals. Flavour chemicals certified as safe for ingestion by the Flavor Extracts Manufacturers Association may not be safe for use in e-cigarettes. This study identified and measured flavour chemicals in 30 e-cigarette fluids.

Methods

Two brands of single-use e-cigarettes were selected and their fluids in multiple flavour types analysed by gas chromatography/mass spectrometry. For the same flavour types, and for selected confectionary flavours (eg, bubble gum and cotton candy), also analysed were convenience samples of e-cigarette fluids in refill bottles from local ‘vape’ shops and online retailers.

Results

In many liquids, total flavour chemicals were found to be in the ∼1–4% range (10–40 mg/mL); labelled levels of nicotine were in the range of 0.6–2.4% (6 to 24 mg/mL). A significant number of the flavour chemicals were aldehydes, a compound class recognised as ‘primary irritants’ of mucosal tissue of the respiratory tract. Many of the products contained the same flavour chemicals: vanillin and/or ethyl vanillin was found in 17 of the liquids as one of the top three flavour chemicals, and/or at ≥0.5 mg/mL.

Conclusions

The concentrations of some flavour chemicals in e-cigarette fluids are sufficiently high for inhalation exposure by vaping to be of toxicological concern. Regulatory limits should be contemplated for levels of some of the more worrisome chemicals as well as for total flavour chemical levels. Ingredient labeling should also be required.

Electronic-cigarette use among young people in Wales: evidence from two cross-sectional surveys

Abstract

Objectives

To examine the prevalence of electronic(e)-cigarette use, prevalence of e-cigarette and tobacco use by age, and associations of e-cigarette use with sociodemographic characteristics, tobacco and cannabis use among young people in Wales.

Design

Data from two nationally-representative cross-sectional surveys undertaken in 2013–2014. Logistic regression analyses, adjusting for school-level clustering, examined sociodemographic characteristics of e-cigarette use, and associations between e-cigarette use and smoking.

Setting

Primary and secondary schools in Wales.

Participants

Primary-school children aged 10–11 (n=1601) and secondary-school students aged 11–16 (n=9055).

Results

Primary-school children were more likely to have used e-cigarettes (5.8%) than tobacco (1.6%). Ever use of e-cigarettes remained more prevalent than ever use of tobacco until age 14–15. Overall, 12.3% of secondary-school students (aged 11–16) reported ever using e-cigarettes, with no differences according to gender, ethnicity or family affluence. The percentage of ‘never smokers’ reporting having used e-cigarettes was 5.3% at age 10–11 to 8.0% at age 15–16. The proportion of children who had ever used an e-cigarette and reported currently smoking increased from 6.9% among 10–11 year olds to 39.2% in 15–16 year olds. Only 1.5% (n=125) of 11–16 year-olds, including 0.3% of never smokers, reported regular e-cigarette use (use at least once a month). Current weekly smokers were 100 times more likely than non-smokers to report regular e-cigarette use (relative risk ratio (RRR=121.15; 95% CI 57.56 to 254.97). Regular e-cigarette use was also more likely among those who had smoked cannabis (RRR 53.03; 95% CI 38.87 to 80.65).

Conclusions

Many young people (including never-smokers) have tried e-cigarettes. However, regular use is less common, and is associated with tobacco cigarette use. Longitudinal research is needed to understand age-related trajectories of e-cigarette use and to understand the temporal nature of relationships between e-cigarette and tobacco use.

French MPs vote to change laws on smoking, nutrition, binge drinking, fashion models

France’s lower parliament voted in favour of a package of wide-ranging reforms affecting many areas of public health regulations on Tuesday. Many public health lobbyists are happy about the changes, although they say some measures still need to be elaborated in practice.

Most of the attention the proposals of Health Minister Marisol Touraine have received in the French media has revolved around protests from doctors over changes to fee payment systems.

However, it also contains far-reaching measures on regulations around smoking, including making it illegal to smoke inside of a vehicle with someone under 18 years of age or to smoke electronic cigarettes in workplaces.

But the main measures really clamp down on marketing in the tobacco industry, including the implementation of plain packaging for all cigarette brands.

“It’s the end of the possibility for the tobacco industry to use packaging as a marketing tool, because there’s no space for advertising on the new package,” says Stephen Lequet, chief lobbyist with French NGO Non-Smokers’ Rights, in reference to a ban to come into effect as of May 2016.

The measures would also oblige tobacco companies to provide details on their marketing and advertising activities, including spending figures.

“I’m also happy about the new rules about transparency in lobbying, because it’s important for society to know the lobbying means used by this particular industry,” Lequet said.

Other measures address issues of nutrition and obesity, including the introduction of a new labelling system for food products. “It’s very important for consumers to know more about the nutritional value of the food they eat on a daily basis, because the present nutritional labelling is very difficult to understand for the average consumer,” says Olivier Andrault, food manager with consumer association UFC Que Choisir. “It talks about carbohydrates and sodium and saturated fat, which is totally illegible for normal people.”

UFC Que Choisir has campaigned alongside doctors and nutritionists for an easier-to-read system. However, although the new law paves the way for a new system, it does not say exactly which system will be used.

“The new law just gives a general principle that the government and the various actors in the food sector will try to develop, but there is a fierce battle between the food industry, retailers, consumer organisations and health authorities,” Andrault explains. For example, a system proposed by doctors would give a letter grade based on the nutritional value of a product, while distributors would prefer a system based on how many times a week any given product should be consumed. “Most of the food industry does not want any simplified labelling scheme,” he says. “The reason is very simple: they do not want the consumer to know too clearly the bad nutritional quality of their products. [But] for retailers, it’s interesting to see a very positive attitude.”

Andrault explains how supermarket chains are working together to devise a common system, and hopes it can be used to fulfil the requirements of the new law.

“We hope health authorities and retailers will manage to define a common scheme, because what is important for us is to have one official, simplified scheme that will be used throughout France for all food products.” Another set of proposals targets the modelling and fashion industry in hopes of fighting anorexia and health issues related to image issues.

One law would force agencies to ensure that a model’s body mass index is at a healthy level, while another restriction would force magazines and advertisers to include labels that say whether images of models have been altered.

Now those in favour of these measures are happy they’re included, but there are also concerns about their effectiveness given the nature of the fashion industry.

“It’s great this law is being passed, even though the reality of the fashion industry is that it doesn’t just happen in Paris, it also happens in New York, Milan and London,” says Natalie Yuksel, a British fashion photographer based in Paris.

“I feel it’s a law that has to be passed in all those countries for it to really work,” she says. “I just don’t see realistically how the law can just be applied to France, as the same girls will show in all of the other cities. I just hope on the back of this, the other cities will also implement this law.”

But Yuksel is also hopeful the reform could be part of wider changes in the international fashion world.

“If there’s enough noise about something, change does happen,” she says.

Other measures include banning those under the age of 18 from tanning salons and fighting binge drinking among young people.

The law would impose fines of up to 15,000 euros and up to a year in prison for anyone encouraging the excessive consumption of alcohol
